well its the san mateo police department. well i get a knock at my door this morning and its the detectives from the san mateo police dpt. i say hello and they ask is this the residence of Leonard Santos and i say yes. well they tell me they are investigating a hit and run that occured a few days ago. i say ok. well they say do u own a 96 plymouth neon. i say i use to and they well how long did i get rid of it. i say like november of last year. they well what did u do with it . i say i gave it a o nonprofit for a tax right off. they say do u have proof of this transaction. i say sure lemme get the paperwork. . well i come back and show them all the paper work. they say ok well we need to ask a few morequestions i say sure. what was the reason foir getting rif it. i say well we had just bought a new volvo and didnt need it anymore and didnt want to go thru the hassle of selling it so we did research on non profits to give it to the best one we seemed fit. well they ask did u get a transfer of title from them. i said no because when do u ever do that when u sell it. they asked because somone paid for the registration in my name and committed fraud. so at this moment i amd like damn i am dso screwed because they still used my name to register it. well they ask me to contack the non profit and ask them a few quaetions on speaker.(i thought this was odd). so i call and get all answers and the police say ok. well after all that i find out that they dont register in there name they just put me down for a no liability transfer at the dmv. well the police say okay well we will eliminate as a suspect but will still need to keep in contact withu . i say no problem. cool all that done i think. then i get a call from the tow company and storage yard and they tell me since the car was still registered under me that i am liable for the 30 day impound and the tow fee. (like $2000). i say hell no. i have a relase of liability. well they tell me that doesnt mean nothing. i wanted to them to go to hell. i tell them i had just spoken to the police and they have cleared me. they said well that doesnt matter. he said if i dont pay when time is up and if they cant auction the car that they will sned me to collections. they told me the best way to handle it is to pay them then to take the non profit to court to recoup my money. i said we shall see. now my question is do they have the right to take me to collections if i have a release of liabilty from the dmv? does anyone know or ever had anything like thi happen to them. this a complete night mare. i amd so glad that no one doied in the hit and run. i think i would be at the police atstion right now. i could really use some feed back. this is starting to eat at me. i feel like calling the tow company and telling them to go suck a duck. what should i do consult a lawyer which i cant afford right now?

Glow Bug, did you file a release of liability with the D.M.V. within 10 days of the transaction of the vehicle with the non profit organization? Because if you did that relieves you of any liability of that vehicle. This is the entire purpose of the mandatory "Release of Liability" form.

well i dint i signed over the pink slip and then they(well i think so) i need to look) did within 10 days. is there really a law that states it has to be done in 10 days.

Write the tow company as soon as possible by certified mail stating
that you are not responsible for said vehicle including a copy of paperwork and release of liability. Use strong words not to attempt to contact you again. They can send you to collections and if they do then you have 30 dyas to dispute the claim. You do the same thing again and it should all go away.

That doesn't matter as long as you did it before the hit and run
You can also contact DMV and get a print out of vehicle history.

I disagree with a lawyer here.
It is only a finacial collection issue, not a criminal matter.

Glow Bug, I am trying to look this up but my internet is not cooperating. But go here and it should tell you exactly what is required for the Release this is a government site and is credible (California Department of Motor Vehicles).

And here is a site on car donations they have a list of freq asked questions that specifically on the legal paper work. (California Car Donation Information - Everything you need to donate in CA). Keep in mind this is a business.. They are trying to sell you on something. So you will need to check the credibility of the information.

well thanks lori and ringo. its got me worried because with my current financial status this would really put me in a hole. i really dont need this. i was told by the tow company that they will contact dmv and if they get the release of liability then they will dismiss any payment that i owe the, i said i can fax it to them and they so no they need it directly from dmv. man what a dam,n headache. i cant even toke because it has me bothered so much. the hit and run happned a few days ago so it is well after the realease wad one. the tow company told me most like 99% of all non profits lag on things like this htey said if u cant sell it then salvage it. i should have just sold it for free. i hope this works out. thanks everyone for the help. i appreciate it. man this is the best place ever.

How do I release the liability of my donated vehicle in California?

The California DMV requires the donor to mail in the "Release of Liability" form that is attached to your title on the day that the car donation is processed and the vehicle is picked up by our agent. If you do not have a "Release of Liability" form, you can download one from the California Department of Motor Vehicles website.

I really don't think you are going to have any serious issues from this as long as you have all the documentation.

okay well i have heard back from the tow company and the non profit. i have no liabilites since the since the liabilty release was done one hour after i gave it to them. phew what a weight of my shoulders. thanks everyone for your help. and the knock knock thing is a joke that kids tell. like knock knock whos there. joe. joe who. joe momma.
